2022: Initial Concerns Raised
Concerns were raised about inconsistencies in community governance and requests were made for access to financial records. The requests were not fulfilled within the deadlines established by law, and email communications were subsequently restricted without clear due process.
CC&R Updates and Grandfather Clause
The 2008 CC&Rs did not include a grandfather clause, and references appeared to be made to a single staff member's memory rather than official records. After selective enforcement concerns were brought to the board's attention, the 2024 CC&Rs were updated to include a grandfather clause.
This raises questions about whether the change was a retroactive acknowledgment of the issue that had been highlighted, and why earlier requests and communications were ignored or restricted.
Community Access Challenges
Requests for basic community access—including building keys, parking stickers, and opportunities for mediation—were repeatedly submitted through Pilera and posted on community bulletin boards. Many of these posts were removed or censored, and fines totaling $10,000 were issued for actions such as chalking, even when the content was factual or procedural.
This pattern highlights ongoing challenges in accessing information, participating in community processes, and engaging transparently with the HOA.
Ongoing Concerns
Repeated selective enforcement, harassment, and pressure from multiple community members created additional challenges. Certain individuals positioned themselves as experts, volunteers, or insiders, often providing misleading or inconsistent information about financial, safety, and property-related matters.
Combined with ongoing challenges around community rules—such as flooring, bulletin boards, and postings—these actions contributed to a climate that created confusion, intimidation, and pressure for those who speak up to disengage.
Legal Context
Voting Rights. As of January 1, 2020, a member's voting rights can no longer be suspended. (Civ. Code § 5105(h)(1): a ballot cannot be denied to a member for any reason other than not being a member at the time when ballots are distributed.)
